The single most useful question when planning a remote hire is not what to call them, but where their laptop physically is. UK-based hires run through UK PAYE with RTI filed on or before payday and auto-enrolment pension duties from the first qualifying employee. Someone living and working in another country generally creates obligations in that country, whatever the contract says or which bank account pays them.

That can mean a local payroll registration, employer social security at rates well above UK National Insurance in parts of Europe, and, where the person is senior enough to negotiate or conclude contracts, a permanent establishment that makes part of your profit taxable locally. None of it is a reason to avoid hiring abroad; all of it is a reason to price it before the offer letter.

Contractor or employee, tested honestly

Status is decided by how the relationship works, not by the label on the invoice. Control over how and when the work is done, a genuine right of substitution, and whether there is an obligation to offer and accept work are the tests HMRC applies. Under the off-payroll rules, medium and large clients make the status determination for personal service company engagements; small clients do not, which leaves the responsibility with the worker's own company.

Overseas contractors sit outside UK PAYE, but most countries run an equivalent test, and several treat a long-term exclusive contractor as an employee by default. Fixed monthly retainers, company email addresses and set hours are the details that lose these arguments later.

Employer of record: the useful shortcut

An employer of record employs the person locally on your behalf and invoices you. It solves the entity, payroll and compliance problem in days rather than months, typically for a few hundred pounds per person per month on top of local employment cost.

It is the right answer for a first hire in a country, or for testing a market. Once you have several people in one country, running local payroll, or a local entity, usually costs less and gives the team a normal employment relationship.

Equity across borders

EMI options, the most tax-efficient UK scheme, require a working time commitment in the UK, so most overseas team members cannot hold them. Unapproved options, growth shares or country-specific plans are the alternatives, each with a different tax point for the individual, sometimes on exercise, sometimes earlier.

Agree the equity approach before you promise anything in a hiring conversation. Repricing or restructuring a promise made informally is expensive and damages trust with exactly the people you were trying to keep.
